Divorce forces sale of property
Divorce is a time of uncertainty and turmoil for most people. I recommend not doing anything, until your thoughts clear some time after the divorce. The judge, in most cases, will do what is best for all concerned, and if that included the sale of your property, several things are important.
You must get an honest value for your property! This means doing a Competitive Market Analysis for your area to find the price of comparable sold properties,in your neighborhood. It is in your best interest to have an agent, with the software and tools, to do the data queries of the local MLS (multiple listing service) database of sales information. Once the price of similar properties are found, a value can be set on your property.
Many try to market the property themselves as FSBO (For Sale By Owner), but the statistics show that properties sold through the MLS sell for 5 - 20% more, on average, than 'For Sale by Owner' properties. A realtor's commission is typically 3%. That realtor is responsible for everything, including advertising. It is a shame to lose up to 17% while trying to save yourself 3%. When you hire a realtor to market your property, it has a better chance of being priced correctly, thereby, selling in a reasonable amount of time. When your property is added to the MLS , which only an agent/broker can do, 1000 other brokers become your sales team.
The other problem with a FSBO sale is the possibility of getting into contractual agreements that may not be in your best interest. A broker is your representative to protect your interest in one of your largest investments.
"If you contact a real estate agent from an advertised listing, be advised, that they are working for the seller, not the buyer! Did Did you know that the seller will pay me to represent you and protect your interest? If a deal is made, the commission (paid by the seller) is split between the real estate brokers. It does not cost you any money to hire a real estate broker to negotiate your interests.
If you have a law degree or are an experienced buyer or seller you may be able to handle this job. Having said that let me tell you I have had attorneys for clients to buy and sell houses. It is not in my best interest to tell you to wait...but I truly believe it is in your best interest to wait for a period of time after the divorce, before making any drastic changes in your life. This includes selling/moving, etc. Did you know that brokers are held by a code of ethics and "Agency" (legal term) to protect your interest even ahead of the broker's interest?
